Wayne & Josh operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Wayne & Josh is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Nothing in these Terms excludes, restricts or modifies any right or remedy, guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other law which cannot lawfully be excluded.

When you place an order, you are making an offer to purchase. Wayne & Josh reserves the right to accept or decline your order for any lawful reason. Your order is not accepted until Wayne & Josh confirms acceptance. We must receive and process your payment before your order is accepted.
Please review your order carefully before submitting. In the event that we do not accept, change, or cancel an order, we will notify you using the contact details provided at the time the order was made and refund any payment taken in full.
Your purchases are subject to return or exchange in accordance with our Return & Refund Policy and your rights under the Australian Consumer Law.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export, unless otherwise agreed in writing with Wayne & Josh.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed and will be set out in your order confirmation email. All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Prices do not include shipping or handling charges unless expressly stated.
Prices in our online store may differ from prices offered through third-party platforms. We may offer promotions from time to time that are governed by separate terms and conditions. Where there is a conflict between promotion terms and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate payment and account information for all purchases. You represent and warrant that you are authorised to use the payment method provided.
SECTION 5 - SHIPPING AND DELIVERY
All delivery times are estimates only. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our reasonable control. Nothing in this section limits your rights under the Australian Consumer Law where goods are not delivered within a reasonable time.
Risk of loss or damage passes to you when the goods come into your physical possession, or into the possession of a person identified by you to take delivery. Please refer to our Shipping Policy for full details.
SECTION 6 - CONSUMER GUARANTEES
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To make a claim under these guarantees, contact us at info@wayneandjosh.com with your order number and details of the problem. We will respond within 24 hours and advise on the next steps. Any costs of claiming under the consumer guarantees, such as return postage for a faulty item, will be borne by us.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and the design, selection and arrangement thereof, are owned by Wayne & Josh, its affiliates or licensors and are protected by Australian and international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material from the Services without our prior written consent. All rights not expressly granted herein are reserved by Wayne & Josh.
Wayne & Josh names, logos, product and service names, designs and slogans are trademarks of Wayne & Josh or its affiliates or licensors. You must not use such trademarks without prior written permission. Shopify's name, logo and related marks are trademarks of Shopify Inc.

Nothing in these Terms excludes, restricts or modifies the consumer guarantees, rights or remedies conferred on you by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.
Where our liability for a failure to comply with a consumer guarantee may be limited under section 64A of the Australian Consumer Law, our liability is limited, at our option, to the replacement of the goods, the supply of equivalent goods, the repair of the goods, or the payment of the cost of any of these.
Subject to the above, and to the fullest extent permitted by law, Wayne & Josh, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors shall not be liable for any indirect, incidental, punitive, special or consequential loss of any kind, including lost profits, lost revenue, loss of data or replacement costs, arising from your use of the Services.
SECTION 16 - INDEMNIFICATION
You agree to indemnify Wayne & Josh and our affiliates, officers, directors, employees, agents and service providers against any losses, damages, liabilities or claims, including reasonable legal fees, to the extent they arise from your deliberate or negligent breach of these Terms, your violation of any applicable law, or your infringement of the rights of a third party. This indemnity is reduced to the extent that our own acts or omissions contributed to the loss.
SECTION 17 - SEVERABILITY
If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
SECTION 18 - WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. These Terms of Service, together with our Privacy Policy, Shipping Policy, Payment Policy and Return & Refund Policy, constitute the entire agreement between you and Wayne & Josh regarding your use of the Services.
SECTION 19 - ASSIGNMENT
You may not transfer or assign this agreement or any of your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms and our rights and obligations, provided that doing so does not reduce the rights you have under these Terms or under the Australian Consumer Law.
SECTION 20 - GOVERNING LAW
These Terms of Service and any disputes arising out of or in connection with them are governed by the laws of Victoria, Australia. You and Wayne & Josh submit to the non-exclusive jurisdiction of the courts of Victoria and the courts of appeal from them. Nothing in this section prevents you from bringing a claim in the courts or tribunal of the state or territory in which you reside.
SECTION 21 - CHANGES TO TERMS OF SERVICE
We may update, change or replace part of these Terms of Service by posting updates to this page. We will notify you of any material changes before they take effect. Changes will not apply retrospectively to orders you have already placed. Your continued use of the Services following any changes constitutes your acceptance of the revised Terms.
